Heathrow On the Day Purchases Terms and Conditions

1. INTRODUCTION
1.1 These terms and conditions ("Terms") govern your use of Heathrow’s On the Day Purchases service available at airside Reserve and Collect collection points at the airport (“On the Day Purchases”).
1.2 The On the Day Purchases service is operated by Heathrow Airport Limited and facilitated by a digital checkout hosted by Stripe Payments Europe Limited. Heathrow Airport Limited is a private limited company registered in England under company number 01991017. Registered office address: The Compass Centre, Nelson Road Hounslow TW6 2GW (“Heathrow”). For the purposes of these Terms "we", "our" and "us" refers to "Heathrow".
1.3 Please read these Terms carefully before you make an On the Day Purchase because they contain important information about how such purchases work.
1.4 On the Day Purchases are made by scanning a QR code and making payment through a secure online checkout. When making an On the Day Purchase, you will need to expressly agree to these Terms. You will also need to enter into separate terms and conditions with Stripe (the Stripe Terms and Conditions) in relation to your use of the online checkout to make a purchase. If you do not agree with these Terms or the Stripe Terms and Conditions, you must not proceed with or make an On the Day Purchase.
1.5 By agreeing to these Terms, you confirm that you are happy for all correspondence and information relating to your purchases (as applicable) to be provided by electronic communication, rather than in paper form. Heathrow reserves the right to communicate with you in paper form where email is unavailable or in addition to email where it deems that to be appropriate.
1.6 These Terms refer only to your use of Heathrow On the Day Purchases and separate conditions may apply to prize draws, competitions and other promotions which we may run from time to time.
1.7 You will also need to enter into separate terms and conditions in relation to the sale of any products to you by individual retailers. We refer to these sale of goods terms as “Retailer Terms & Conditions of Sale”.
2. WHAT IS HEATHROW ON THE DAY PURCHASES?
2.1 The Heathrow On the Day Purchases service offers an opportunity for passengers travelling through Heathrow airport (“Heathrow Airport”) to buy products directly from leading retailers. Passengers can make an inperson purchase at the checkout by scanning a QR code linked to a specific product and paying using a secure hosted online checkout. Once payment is authorised passengers receive the goods there and then.
All products are made available to you by the individual retailers operating on the Reserve & Collect Website (each a “Retailer”). The products are not being sold by Heathrow.
Heathrow is not a party to any sales contracts for the products made available via On the Day Purchases. By placing an order for an On the Day Purchase via the online checkout you understand that:
2.1.1 you will purchase products from the Retailer, not Heathrow;
2.1.2 each Retailer making products available for On the Day Purchases has their own terms and conditions which will apply to your contract with them, and you will be required to agree to the applicable Retailer Terms & Conditions of Sale before making a purchase; and
2.1.3 Heathrow does not, in any way, guarantee or endorse any product made available for On the Day Purchases.
2.2 Heathrow will only be assisting each Retailer in facilitating the sale of goods contract (including assisting with the receipt and processing of refunds and returns) and at all times does so on behalf of the Retailer.
Any issues arising under your sale of goods contract with a Retailer will be a matter between you and the individual Retailer.
3. HOW DOES ON THE DAY PURCHASES WORK?
| Where can I make an On the Day Purchase? | On the Day Purchases can be made at the Collection Locations situated after aviation security, where customers also collect purchases made via the Heathrow Reserve & Collect website. On the Day Purchases offers an opportunity for passengers to purchase a limited selection of products without having made a prior purchase or reservation via the website. Available products will be displayed at the Collection Locations. |

| Where can I find further information about the products on offer? | Staff at the Collection Location can provide you with a QR code for each product, which contains information including the product’s price and description and the name of the relevant Retailer. |
| How do I purchase a product? | By clicking a QR code presented to you at the Collection Point you will be taken to the online check out hosted by Stripe. By entering your email address, cardholder name and billing details, accepting applicable T&Cs and pressing the “Pay” button, you enter into a purchase contract for the product. |
| Can I purchase multiple products in the same transaction? | Because each QR code is unique to one product, if you wish to purchase two or more different products (whether from the same or different retailers) you will need to make separate purchase transactions for each. You can purchase two or more of the same product in a single transaction. |
| What terms and conditions apply to my reservation / order? |
The relevant Retailer Terms & Conditions of Sale will apply. Each Retailer making products available for On the Day Purchases has its own terms and conditions which will apply to your sale of goods contract with each such Retailer. These Retailer Terms and Conditions can be read
here . You will be required to agree to the relevant Retailer’s Terms & Conditions of Sale before making a purchase. These Retailer Terms & Conditions of Sale form the basis of the sale of goods contract between you and the relevant Retailer. The Retailer is under a legal obligation to provide certain information to you (e.g. price and characteristics of goods, return and cancellation policies) before you are bound by the Retailer Terms & Conditions of Sale. This information will be made available to you on the online checkout page and will also be confirmed to you by email following your purchase. The Retailer is also under an obligation to provide you with confirmation of the contract. The Retailer also offers the Heathrow Returns Promise, which is available here . Please follow the instructions there to make a return. |
| Are there any restrictions when making On the Day Purchases? | Retailers may have individual order limits and/or other restrictive terms and conditions with respect to the products that they offer for On the Day Purchases, which will be notified to you at the time you place your order. |
| When does my contract with the retailer become binding? When and how is payment taken? |
Your contract with a Retailer will become legally binding after successful payment for the goods at the online checkout. Your legal rights to cancel the contract will be as described in the Heathrow Returns Promise and within your sale of goods contract with the Retailer. To make an On the Day Purchase you will scan a QR code at the Collection Point. The QR code will take you to a secure third party online checkout where you can make payment for the goods. You can only pay using credit cards, debit cards, Apple Pay, Google Pay or such other payment methods that are made available from time to time on the secure third party online checkout. We will receive the payment on behalf of the Retailer and on completion of the payment you will receive a confirmation and invoice which can be downloaded from the online confirmation page. We will also send you an email receipt which may be issued on Heathrow’s behalf using a third party system. Your bank statement will refer to “Heathrow.com” and not the Retailer, even though we are collecting the money on the Retailer’s behalf. |
| What happens after I have paid? | Following successful payment you will receive a digital confirmation of purchase. The representative at the Collection Location may ask to check this digital confirmation before handing your purchased product(s) to you. |
| Can I collect or use Heathrow Rewards on a purchase? | Heathrow Rewards Points cannot be collected automatically when making an On the Day Purchase. |
| How can I return my items once I have purchased them? |
The Heathrow Returns Promise explains your rights regarding returns and refunds in relation to On the Day Purchases made by you. You must not return the goods directly to the Retailer, unless agreed. This means that you must not return the goods to any In Airport Retailer Store. To the extent relevant, any additional after sales services or Retailer specific guarantees will be made available to you either by the Retailer in their terms and conditions of sale, or at the time you place your order (or if this is not possible, within a reasonable time after that, but no later than when you collect your products). Please note that given all On the Day Purchases will be made directly with each Retailer, not Heathrow, your rights of return arise under the sale of goods contract with the Retailer. Heathrow’s involvement in processing all returns is therefore strictly limited to acting on behalf of each Retailer, and as such, we are not liable to you in any way in relation to such services. For On the Day Purchases you can rely on your digital confirmation or paid invoice as proof of purchase. Refunds will normally be processed to the original payment method within five working days once approved. |
4. PRICE & PAYMENT REQUIREMENTS
4.1 All prices of products available for On the Day Purchases include any VAT payable unless otherwise specified.
4.2 All customs, export and excise duty, VAT and other taxes associated with the sale between you and a Retailer will be paid by you, if applicable.
4.3 It is the Retailer’s responsibility to determine, collect and remit the applicable VAT, customs, import, export and excise duties and other taxes associated with the sale of the goods.
4.4 On occasion, the prices payable in respect of products made available for On the Day Purchases may differ from the price of the same products which are made available for sale at the same time in an InAirport Retailer Store at Heathrow Airport or a Retailer’s own stores outside of Heathrow Airport (as applicable).
4.5 Although efforts are made to ensure that all pricing information for products available for On the Day Purchases are accurate, occasionally an error may occur, and products may be mispriced. If we (or a Retailer) discover a pricing error we will, at the Retailer’s discretion, either contact you on behalf of the Retailer to ask whether you wish to continue with the reservation request/order at the correct price or notify you on behalf of the Retailer that the Retailer has cancelled your reservation or order (as applicable). If you have already paid for the product when the pricing error is discovered and you opt to cancel your purchase and request a refund, all amounts paid by you will be refunded to you.
4.6 There are no associated costs of shipping or delivery of any product, as collection of products is only permitted at a Collection Location.
4.7 It is your responsibility to check any restrictions or rules when taking certain items such as food and/or drink to destinations outside of the United Kingdom as part of your journey. We may make items available for On the Day Purchases which you may not be permitted to take to your next destination. We will not be responsible if you do not comply with such restrictions or rules.
5. OUR LIABILITY TO YOU
5.1 Subject to paragraph 5.4 below, we are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure to comply with these Terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
5.2 You acknowledge that Heathrow has no liability to you under the sale of goods contract you enter into with a Retailer.
5.3 Heathrow accepts no liability in the event that products are not available for purchase by you On the Day at a Collection Location.
5.4 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; and for defective products under the Consumer Protection Act 1987.
6. INTELLECTUAL PROPERTY RIGHTS
6.1 You may not do any of the following:
6.1.1 remove the copyright or trade mark notice from any copies of content under these Terms; or
6.1.2 create a database in electronic or structured manual form by systematically downloading and storing any content.
7. GENERAL TERMS
7.1 Any personal information you supply to us when you make an On the Day Purchase will be used in accordance with our privacy notice privacy policy notice.
7.2 In accordance with our accessibility statement Heathrow is committed to meeting the requirements of the Equality Act and we make every effort to ensure that On the Day Purchases are accessible to people with special needs, including those with visual, hearing, cognitive and motor impairments.
7.3 Please check this page from time to time to take notice of any changes that may be made, as any changes will govern any On the Day Purchases that you make following the change taking effect.
7.4 These Terms, their subject matter and their formation, are governed by English Law. You and we both agree that the courts of England and Wales will have nonexclusive jurisdiction. However, if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
7.5 Each of the paragraphs of these Terms operate separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
