1. Introduction

1.1 These terms and conditions ("Terms") govern your use of the website (https://boutique.heathrow.com/) (the "Heathrow Reserve & Collect Website").

1.2 The Heathrow Reserve & Collect Website is operated by Heathrow Airport Limited. Heathrow Airport Limited is a private limited company registered in England under company number 01991017. Registered office address: The Compass Centre, Nelson Road Hounslow TW6 2GW (“Heathrow”). For the purposes of these Terms "we", "our" and "us" refers to "Heathrow".

1.3 Please read these Terms carefully before you access and/or make a purchase on the Heathrow Reserve & Collect Website because they contain important information about how the Heathrow Reserve & Collect Website works.

1.4 By accessing the Heathrow Reserve & Collect Website you are agreeing to these Terms. When making a purchase on the Heathrow Reserve & Collect Website, you will need to expressly agree to the Terms. If you do not agree with these Terms, you must not proceed with or make a purchase on the Heathrow Reserve & Collect Website.

1.5 By agreeing to these Terms, you confirm that you are happy for all correspondence and information relating to your reservation requests and/or orders (as applicable) to be provided by email, rather than in paper form. Heathrow reserves the right to communicate with you in paper form where email is unavailable or in addition to email where it deems that to be appropriate.

1.6 These Terms refer only to your access and use of the Heathrow Reserve & Collect Website and separate conditions may apply to prize draws, competitions and other promotions which we may run from time to time.

1.7 You will also need to enter into separate terms and conditions in relation to the sale of any products to you by individual retailers. We refer to these sale of goods terms as “Retailer Terms & Conditions of Sale”.

2. WHAT IS THE HEATHROW RESERVE & COLLECT WEBSITE?

2.1 The Heathrow Reserve & Collect Website is an online marketplace where passengers travelling through Heathrow airport (“Heathrow Airport”) can reserve and buy products directly from leading retailers.

What products are available on the Heathrow Reserve & Collect Website?

2.2 There are two types of products made available on the Heathrow Reserve & Collect Website:

2.2.1 Reserve & Collect Pay on Collection products (also known as “Pay on Collection products”) – these products are available for passengers to reserve online and to collect in-terminal from the retailer’s store(s) at Heathrow Airport’s international departure lounge (“In-Airport Retailer Store”). For these products, payment will be made and processed when you collect the product; and

2.2.2 Reserve & Collect Pay in Advance products (also known as “Pay now products” on the Heathrow Reserve & Collect Website) – these products are available for passengers to order and pay for directly online through the Heathrow Reserve & Collect Website in advance of collection from a designated collection location at Heathrow Airport which may include the In-Airport Retailer Store, a Heathrow operated collection point located in the international departures lounge after you pass through security at Heathrow Airport (“R&C Collection Point”), and participating airport lounges (together the “Collection Locations”).

All products are made available to you by the individual retailers operating on the Reserve & Collect Website (each a “Retailer”). The products are not being sold by Heathrow.

Who am I contracting with when making a purchase via the Heathrow Reserve & Collect Website?

2.3 Heathrow is not a party to any sales contracts for the products made available on the Heathrow Reserve & Collect Website. By placing orders, and reserving products through the Heathrow Reserve & Collect Website, you understand that:

2.3.1 you will purchase products from the Retailer, not Heathrow;

2.3.2 each Retailer making products available on the Heathrow Reserve & Collect Website have their own terms and conditions which will apply to your contract with them, and you will be required to agree to the applicable Retailer Terms & Conditions of Sale before making a purchase or placing a reservation order; and

2.3.3 each Retailer making products available on the Heathrow Reserve & Collect Website have their own terms and conditions which will apply to your contract with them, and you will be required to agree to the applicable Retailer Terms & Conditions of Sale before making a purchase or placing a reservation order; and

2.4 Heathrow will only be assisting each Retailer in facilitating the reservation requests and the sale of goods contract (including assisting with the receipt and processing of refunds and returns) and at all times does so on behalf of the Retailer.

Any issues arising under your sale of goods contract with a Retailer will be a matter between you and the individual Retailer.

3. HOW DO THESE RETAIL OFFERINGS WORK?

3.1 The applicable terms that will apply to you will depend on whether you are making a reservation request for a Reserve & Collect Pay on Collection product, or placing an order for a Reserve & Collect Pay in Advance product. We summarise the applicable terms below:

What will I need to make a reservation request/place an order?

Before being able to select a product to reserve/order on the Heathrow Reserve & Collect Website, you must confirm your departure flight details. This will allow us to ensure that you are only able to select those products which can be made available for collection at the terminal at Heathrow Airport you are flying from on your date of travel.

All products shown on the Heathrow Reserve & Collect Website are offered to you to collect in the international departures lounge after you pass through security at Heathrow Airport. The relevant location to collect your order will be stated in the order confirmation email that we will send to you.

You must have a valid boarding card for a departing flight or other appropriate legal authority to access a Retailer’s store or the R&C Collection Points located in the international departures lounge after you pass through security at Heathrow Airport, to collect (and where relevant, pay for) products.

What collection options are available for my reservation request/order?

You can collect your order at the In-Airport Retailer Store. The relevant location will be stated in the order confirmation email that we will send to you.

When you make your purchase online, the collection option will default to collection from a R&C Collection Point, however, you may be able to select to collect from an In-Airport Retailer Store (depending on the participating Retailer).

Alternatively, you may be entitled to collect your purchase from a participating airport lounge located after aviation security.   We will notify you if you are entitled to use this collection option. Please refer to the section below for further information - Can I collect my order from an airport lounge? [LINK]).

Your selected location will be stated in the order confirmation email that we will send to you.

Can I collect my order from a R&C Collection Point?

No.

 

Yes, if you have selected that option when making your order online.

Can I collect my order from an airport lounge?

No.

Yes, if we notify you that you are entitled to use this collection option, and you have selected that option when making your order online. Where available, we will offer this collection option free of charge.

Our representative will contact you via phone and/or email before the date of your flight to confirm the relevant participating lounge and your arrival time.

If for any reason this collection option is no longer available, you will be notified prior to your collection time and you may be offered to collect your order from an alternative Collection Location.

This collection option is subject to availability.  Participating lounges may vary from time to time.

Can I collect my order from an In-Airport Retailer Store?

Yes, if you have reserved a product from a Retailer on the Heathrow Reserve & Collect Website that has a store at Heathrow Airport.

Yes, if the Retailer offers collection from its In-Airport Retailer Store for Reserve & Collect Pay in Advance products.

Can I make a reservation request/place an order with multiple Retailers

Yes. You can have a “Mixed Basket Order” where you make a reservation for merchandise or an order for merchandise from more than one Retailer. In such circumstances you will need to agree to the Retailer Terms & Conditions of Sale for each Retailer.

You can also place a Reserve & Collect Pay on Collection and a Reserve & Collect Pay in Advance order at the same time. However, a Mixed Basket Order cannot include any Reserve & Collect Pay in Advance orders that you have selected to collect from a participating airport lounge. Where you do this, there might be some differences that apply to your order as described in these Terms and the Heathrow Returns Promise.

You may also have to collect your order from different Collection Locations depending on the Retailer(s). This will be set out in the order confirmation email that we send to you.

 

When will I need to make a reservation request/place an order?

Subject to availability, reservation requests made on the Reserve & Collect Website can only be accepted up to 4 weeks prior to your scheduled flight date

Orders made on the Reserve & Collect Website can only be accepted up to 3 weeks prior to your scheduled flight date, unless otherwise agreed by us.

What terms and conditions apply to my reservation /order?

The relevant Retailer Terms & Conditions of Sale will apply. Each Retailer making products available on the Heathrow Reserve & Collect Website has its own terms and conditions which will apply to your sale of goods contract with each such Retailer.

If you make a Mixed Basket Order, this means that you will have a separate contract with each Retailer which is relevant to the reservation / order.

You will be required to agree to the relevant Retailer Terms & Conditions of Sale before making a purchase or making a reservation. These Retailer Terms & Conditions of Sale form the basis of the sale of goods contract between you and the relevant Retailer.

The Retailer is under a legal obligation to provide certain information to you (e.g. price and characteristics of goods, return and cancellation policies) before you are bound by the Retailer Terms & Conditions of Sale. This information will be made available to you through the Reserve & Collect Website. The Retailer is also under an obligation to provide you with confirmation of the contract.

The Retailer also offers the Heathrow Returns Promise, which is available [Here]. Please follow the instructions there to make a return.

Are there any restrictions when placing orders via the Heathrow Reserve & Collect Website?

Retailers may have individual reservation/order limits and/or other restrictive terms and conditions with respect to the products that they offer on the Heathrow Reserve & Collect Website, which will be notified to you on Heathrow Reserve & Collect Website at the time you place your order/reservation.

As described above, all Collection Locations are located in Heathrow Airport after aviation security, which means that you must have a valid boarding card for a departing flight (or have other appropriate authority to access the relevant collection point) to be able to collect or pay for your order.

What happens once I make a reservation request/place an order?

After submitting a reservation request/order we will (on behalf of the Retailer) send you an acknowledgement email, specifying your reservation/order number and details of the product(s) that you have requested to reserve/order.

Please note that this email is an acknowledgement only and is not confirmation of your reservation request/order. No legally binding contract will have been made between you and the Retailer at this point.

Our representative will contact you before the date of your flight to confirm the time and location for collection at the lounge.

When/how will my reservation request/order be confirmed?

All reservation requests/orders made by you are subject to acceptance by the relevant Retailer(s).

Reservation requests/orders may be declined by such Retailer(s) (or by us on their behalf) for any reason, and the Retailer(s) and Heathrow will not be liable to you or to anyone else in those circumstances.

If the requested product(s) is/are available for reservation/order, a confirmation email will be sent to you by us on behalf of the relevant Retailer(s).

When does my contract with the retailer become binding?

Your contract with a Retailer will become legally binding after successful payment for the goods at the In-Airport Retailer Store.

Your rights to cancel your reservation are described below. Please note that as your sale of goods contract with the Retailer does not come into existence until you pay for your goods, your legal rights to cancel your contract (as described in the Heathrow Returns Promise) will not apply until this point.

Your sale of goods contract with a Retailer will become legally binding when we send you a confirmation email to you (on behalf of the Retailer). 

Your legal rights to cancel the contract will be as described in the Heathrow Returns Promise and within your sale of goods contract with the Retailer.

When and how is payment taken?

You will be required to pay for products on collection.

You may only pay for the goods using credit card and debit card or such other payment methods as may be notified to you at the time you make your reservation.  

Unless otherwise agreed with the Retailer at the time of collection, payment by cash, vouchers or other payment in kind will not be accepted.

 

We will take payment on behalf of the Retailer at the time we send you the confirmation email. Your sale of goods contract with the Retailer will set out more detail about how payment is taken, and what pre-authorisations are taken.

You can pay for the goods using credit cards, debit cards, or such other payment methods that are made available on the Heathrow Reserve & Collect Website from time to time. 

Your bank statement will refer to “Heathrow.com” and not the Retailer, even though we are collecting the money on the Retailer’s behalf.

What information do I need to provide upon collection?

At the In-Airport Retailer Store, you will need to provide:

·       the order number provided in your order confirmation email;

·       proof of age (i.e. valid passport or driving licence) when collecting age restricted products (e.g. alcohol); and

·       proof of your identity (e.g. passport).

If you are using our complementary ‘Collect on Return’ service, you may need to provide additional information when collecting your order. Please refer to the separate terms [shopping-services | Heathrow].

At the Collection Location, you will need to provide:

·       the unique pin code provided in your order confirmation email;

·       the order number provided in your order confirmation email;

·       proof of age (i.e. valid passport or driving licence) when collecting age restricted products (e.g. alcohol); and

·       proof of your identity (e.g. passport).

If you are using our complementary ‘Collect on Return’ service, you may need to provide additional information when collecting your order. Please refer to the separate terms [shopping-services | Heathrow.

How can I collect my products?

 

Once we confirm your reservation or your order, you can proceed to purchase and collect the products at an In-Airport Retailer Store.

You will be given information about how to collect your order in your confirmation email. In-Airport Retailer Store will be open during Heathrow Airport’s operational hours. Details of opening hours are available on our website.

You will not be able to collect your items earlier than the date shown in the confirmation email. 

 

Once we confirm your order, you can proceed to collect the purchased products at the selected Collection Location(s) on the date specified in your confirmation email.

You will be given information about where to collect your order in your confirmation email.

R&C Collection Points and In-Airport Retailer Stores will be open during Heathrow Airport’s operational hours. [These hours are those hours starting an hour before the first scheduled departing flight and ending an hour prior to the last scheduled departing flight in the relevant terminal where the relevant R&C Collection Point or In-Airport Retailer Store is located.] The airport lounge(s) participating in Reserve & Collect Pay in Advance will be open during the hours specified by the lounge operator. Please note that the operational hours of the relevant airport lounge(s) may differ to Heathrow’s operational hours.

You will not be able to collect your items earlier than the date shown in the confirmation email.

What if we change the collection point or time?

If there is any change to the relevant Collection Location or time for collection after the date you receive your confirmation email, you will be notified by email of any such change.

What if my flight times change or my departure terminal changes?

If there are changes to your flight (for example, the timings of your flight or your departure terminal) which mean you are unable to collect the products as originally anticipated, you will need to contact our customer support team at Contact Us | Heathrow Reserve & Collect  to inform them of this change. In such circumstances, you will be given the option to either (i) cancel your order and reorder, or (ii) cancel your order.

If you do not collect your order at the agreed time, and you have not let us know within 48 hours whether you want to cancel and/or reorder, your order will be cancelled.

Please note that changes to flights are not monitored by the Retailers nor us.

If there are changes to your flight (for example, the timings of your flight or your departure terminal) which mean you are unable to collect the products as originally anticipated, you will need to contact our customer support team at Contact Us | Heathrow Reserve & Collect  to inform them of this change and to allow them to redirect your collection to the appropriate Collection Location at the new terminal or to ensure the products are available to collect at the appropriate time. If this is not possible, and/or you wish to cancel your order, you can do so.

If you do not collect your order at the agreed time, and you have not let us know within 48 hours from your collection time that you want to make alternative arrangements to collect your order, your order will be cancelled and you will be refunded for any payments you have made if the order was for Reserve & Collect Pay in Advance product(s). 

Alternatively, you may be able to use our complementary Collect on Return service, subject to availability and separate terms [shopping-services | Heathrow]. Please refer to the row below for further information about the Collect on Return service.

Please note that changes to flights are not monitored by the Retailers nor us.

What if I want to collect my reservation/order on my return journey?

If you have paid for your order at the In-Airport Retailer Store but are unable to collect your order prior to your departure, then please contact the Shopping Services team on 0800 6785324 or shopping.services@heathrow.com who can advise you.  The complementary Collect on Return service may be available subject to availability and separate terms shopping-services | Heathrow.

If you are unable to collect your order prior to your departure, then please contact the Shopping Services team on 0800 6785324 or shopping.services@heathrow.com, or notify a representative at the Heathrow Collection Location.   Subject to availability, you may be able to use the complementary Collect on Return service, which is subject to separate terms shopping-services | Heathrow.

Alternatively, our representative may contact you, subject to availability, to offer for you to use the complementary Collect on Return service, which is subject to separate terms shopping-services | Heathrow.

Can I decide not to collect a reserved/ordered product?

Yes.

 

You will not be charged if you decide not to collect your order. Your order will be cancelled.

 

 

 

Yes, unless the item is perishable or customised or a certain exemption applies (as further detailed below).

You may have rights to cancel your order from the time you receive your confirmation email and at any time prior to that point.

If you do not collect your order at the agreed time, and you have not let us know that you want to make alternative arrangements to collect your order, your order will be cancelled and you will be refunded for any payments you have made. 

How can I return my items once I have collected them?

The Heathrow Returns Promise explains your rights regarding returns and refunds in relation to purchases made by you using the Heathrow Reserve & Collect Website – whether for Reserve & Collect Pay on Collection products or Reserve & Collect Pay in Advance products. You must not return the goods directly to the Retailer, unless agreed.  This means that you must not return the goods to any In-Airport Retailer Store.

To the extent relevant, any additional after sales services or Retailer specific guarantees will be made available to you either by the Retailer in their terms and conditions of sale, or at the time you place your order (or if this is not possible, within a reasonable time after that, but no later than when you collect your products).

Please note that given all purchases made on the Heathrow Reserve & Collect Website will be directly with each Retailer, not Heathrow, your rights of return arise under the sale of goods contract with the Retailer.

Heathrow’s involvement in processing all returns is therefore strictly limited to acting on behalf of each Retailer, and as such, we are not liable to you in any way in relation to such services.

Can I collect or use Heathrow Rewards on a purchase?

If you have registered for a My Heathrow account and are a member of the Heathrow Rewards loyalty scheme, you may be able to earn points when you order  goods  via the Reserve & Collect Website for eligible Reserve & Collect Pay on Collection products and pay for them upon collection at an In-Airport Retailer Store. Please show your Rewards card number to the sales representative at the point of purchase.

If you have registered for a My Heathrow account and are a member of the Heathrow Rewards loyalty scheme, you may be able to redeem points when you reserve or order and collect goods at an In-Airport Retailer Store where the Retailer expressly confirms to you its participation in the Heathrow Rewards scheme.

If you purchase Reserve & Collect Pay on Collection products as a guest user, you will not earn Heathrow Rewards points.

Separate terms and conditions apply to the operation of My Heathrow and   Heathrow Rewards which can be found here: https://www.heathrow.com/terms-and-conditions/myheathrow.

If you have registered for a My Heathrow account and are a member of the Heathrow Rewards loyalty scheme, you may be able to earn points when you order and pay for goods in advance for eligible Reserve & Collect Pay in Advance products.   You must sign in to your My Heathrow account prior to completing the transaction or otherwise include your Heathrow Rewards card number in the relevant field in the checkout process.

If you purchase Reserve & Collect Pay in Advance products as a guest user, you will not earn Heathrow Rewards points.

You cannot in any circumstances redeem or use Heathrow Rewards points or any vouchers as payment in kind to a Retailer with respect to any purchase of Reserve & Collect Pay in Advance products.

When will my Heathrow Rewards Points  balance be updated if I reserve /buy a product using the Reserve &  Collect Website?

 

Heathrow Rewards Points will be awarded 24 hours following collection of the product and the points will show on your points balance in your My Heathrow account (if you have registered).

If you fail to collect the product for any reason, then you will not receive any Heathrow Rewards points.

Can I earn Heathrow Rewards Points on every purchase made through the Reserve & Collect Website?

No. Certain products such as infant formula may be excluded from the Heathrow Rewards scheme from time to time and will not be eligible for Heathrow Rewards Points. Certain retailers might not participate in the Heathrow Rewards scheme from time to time.

4. PRICE & PAYMENT REQUIRMENTS

4.1 If you select to purchase a Reserve & Collect Pay on Collection product, then the Retailer’s representative at the In-Airport Retailer Store will take payment using its own in-store payment method.

4.2 All prices of products listed on the Heathrow Reserve & Collect Website include any VAT payable unless otherwise specified. 

4.3 Duty is payable by the customer for any Reserve & Collect Pay in Advance product which is alcohol and the price for that product which is listed on the Heathrow Reserve & Collect Website is inclusive of the duty payable.

4.4 Duty is not payable by the customer for any Reserve & Collect Pay on Collection product which is alcohol and the price for that product which is listed on the Heathrow Reserve & Collect Website is exclusive of the duty payable due to the ‘duty free’ designation.

4.5 All customs, export and excise duty, VAT and other taxes associated with the sale between you and a Retailer will be paid by you, if applicable.

4.6 It is the Retailer’s responsibility to determine, collect and remit the applicable VAT, customs, import, export and excise duties and other taxes associated with the sale of the goods.

4.7 On occasion, the prices payable in respect of Reserve & Collect Pay on Collection products and Reserve & Collect Pay in Advance products advertised on the Heathrow Reserve & Collect Website may differ from the price of the same products which are made available for sale at the same time in an In-Airport Retailer Store at Heathrow Airport or a Retailer’s own stores outside of Heathrow Airport (as applicable). The relevant product pages will set out clearly to you whether you are receiving any particular discounts or offers from a Retailer.

4.8 The price of the Retailer’s products listed on the Heathrow Reserve & Collect Website (whether Reserve & Collect Pay on Collection products or Reserve & Collect Pay in Advance products) may be discounted or part of a promotion and/or the Retailer’s product may be made available on an exclusive or limited basis on the Heathrow Reserve & Collect Website. You will be made aware of any such offers through the use of particular description tags which will appear alongside the relevant products (as applicable) on the Heathrow Reserve & Collect Website prior to making your order or purchase.

Descriptions on the Reserve & Collect Website

What does the description mean in practice?

“Heathrow Price”

This means that the product is available to buy at a price negotiated between Heathrow and the Retailer either on the Heathrow Reserve & Collect Website or (where applicable) at a Retailer’s In-Airport Retailer Store. 

 

“(You save £)” for products purchased from World Duty Free on the Heathrow Reserve & Collect Website*

*(This applies to World Duty Free products only in the following product categories: cosmetics and skincare, perfume except for beauty gift sets), liquor under £999 and champagne and wine)

TThis means that the price saving for the product is calculated against the ‘average UK high street price’ as set by World Duty Free and may be adjusted to include any additional discount or promotion offered by World Duty Free. See here [UK Airports | World Duty Free]. 

“(You save £)” for products purchased from other Retailers on the Heathrow Reserve & Collect Website (not from World Duty Free)

This means that the price saving for the product is calculated against the Retailer’s base price. This is the price charged for the product by the Retailer in its flagship store, whether a physical store in the United Kingdom or e-commerce platform or offering. In certain circumstances the price may be adjusted to include any additional discount or promotional offer which is made available by the Retailer from time to time, as further specified in the Retailer’s terms and conditions of sale.  We will make a copy of these terms available to you at the time you place your order. 

“Heathrow Exclusive Price”

The Retailer has made this product available to buy at an exclusive price at Heathrow Airport, whether on the Heathrow Reserve & Collect Website and/or in store at Heathrow Airport.

“Travel Exclusive Product”

This means that the product is exclusively available for sale at airports or other transport locations domestically and/or internationally, whether in-store or online

“Heathrow Exclusive Product”

This means that the product is exclusively available for sale on the Heathrow Reserve & Collect Website and/or in-store at the Airport. 

“10% off online” for products purchased from World Duty Free on the Heathrow Reserve & Collect Website

This means that the product is available to buy at a 10% discount compared to the price made available in WDF In-Airport Retailer

Store(s) when the product is reserved online via the Heathrow Reserve & Collect Website.

4.10 Although efforts are made to ensure that all pricing information for products listed on the Heathrow Reserve & Collect Website is accurate, occasionally an error may occur and products may be mispriced. If we (or a Retailer) discover a pricing error we will, at the Retailer’s discretion, either contact you on behalf of the Retailer to ask whether you wish to continue with the reservation request/order at the correct price or notify you on behalf of the Retailer that the Retailer has cancelled your reservation or order (as applicable). If you have already paid for the product when the pricing error is discovered and you opt to cancel your purchase and request a refund, all amounts paid by you will be refunded to you.

4.11 Retailers who list goods on the Heathrow Reserve & Collect Website for sale as a Reserve & Collect Pay on Collection product will not be obliged to supply products for sale at the incorrect price.

4.12 There are no associated costs of shipping or delivery of any product, as collection of products is only permitted at a Collection Location. However, Heathrow Airport does offer onward shipping and delivery as a separate service. 5. YOUR OBLIGATIONS WHEN USING THE HEATHROW RESERVE & COLLECT WEBSITE

5.1 You may only access and use the Heathrow Reserve & Collect Website in accordance with these Terms and, in any event, for lawful and proper purposes which include complying with all applicable laws, regulations and codes of practice within the UK or other jurisdiction from which you are accessing the Heathrow Reserve & Collect Website.

6.LIMITATIONS OF HEATHROW RESERVE & COLLECT WEBSITE

6.1 We do not guarantee that the Heathrow Reserve & Collect Website, or any content on it, will be free from errors or omission and we are under no obligation to update it. For the reasons described above, and because of frequent changes to the retail offerings offered at Heathrow Airport, we cannot guarantee that the information on the Heathrow Reserve & Collect Website will always be completely accurate.

7. OUR LIABILITY TO YOU

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure to comply with these Terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

7.2 You acknowledge that Heathrow has no liability to you under the sale of goods contract you enter into with a Retailer.

7.3 Heathrow accepts no liability in the event that products are not available or provided:

7.3.1 for reservation or order by you on the Heathrow Reserve & Collect Website; or

7.3.2 (following reservation or order on the Heathrow Reserve & Collect Website) for collection by you at Heathrow Airport for any reason; or

7.3.3 where a Retailer fails or declines to conclude the sale of goods contract with you for any reason notwithstanding that your reservation or order (as applicable) may have been previously confirmed.

7.4 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; and for defective products under the Consumer Protection Act 1987.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 All trade-marks, copyright, database rights and other intellectual property rights (together "the rights") in the materials on the Heathrow Reserve & Collect Website (as well as the organisation and layout of the Heathrow Reserve & Collect Website) and the rights in any software or underlying software code that is made available for download from the Heathrow Reserve & Collect Website ("software") are owned or licensed by us or our licensors. Retailer branding used on the Heathrow Reserve & Collect Website belongs to each relevant Retailer.

8.2 Except as stated in paragraph 8.4 below, you may not without our prior written permission copy, reproduce, modify, alter, publish, broadcast, distribute, display, post, sell, transfer or transmit in any form or by any means any material on the Heathrow Reserve & Collect Website or software whether in whole or in part nor use the material or software to create derivative works.
